  1.  1. The purpose of this website is to help connect young travelers from Jewish communities around the world with families (“Hosting Families“) who wish to host youngsters from the Diaspora, or with vacant flat owners offering short term rentals in Israel (“Flat Owners“). Both types of services will be referred to in this document, collectively, as “the Hosting Services”.

  3. 2. This website is operated by the “Israel Experience Educational Tourism Services Ltd.” (“The Company” or “IE“).
  4.  
  5. 3. Through this website, Hosting Families and Flat Owners (“Users“) may post a profile including the following information:
  •  a. In cases of Hosting Families: Information about family members residing in the Hosting Family’s flat, the Hosting Family’s lifestyle and offered accommodation.
  •  b. In cases of short term rentals of vacant flat: Information about the offered accommodation.
  •  
  • 4. The detailed information should be uploaded in accordance with the format set by the Company.
  •  
  • 5. Only one profile per Hosting Family / Flat Owner should be created.
  • 6. It should be emphasized that the Company acts only as a provider of an online marketplace platform that enables registered Hosting Families / Flat Owners to connect and transact with travelers seeking to book Hosting Services (“Travelers“). The Company does not own, manage, control, sell or offer the Hosting Services. The Hosting Services are the sole responsibility of the Hosting Families / Flat Owners. Under no circumstances will the Company be deemed either as having a contractual relationship with any of the Hosting Families, Flat Owners or Travelers, with respect to the Hosting Services, or as offering real-estate brokerage services. Any relationship between the Users and the Company will be limited solely to the operation of the website,under the terms and conditions included in this document.

  • 7. The Company may, immediately and without notice, announce the suspension or termination of the service for no cause; however,
  • any such cancellation will not impede any standing orders which had been placed through the website prior to the cancellation announcement.

  • Limitations on the Scope of the Short Term Flat Rental Service
  •  
  • 8. Accommodation in vacant flats is available only to adult travelers (above the age of 18).
  • Accuracy of Posted Information
  •  
  • 9. By posting the profile, the Hosting Family / Flat Owner declares that all details, pictures and other information included in the profile are genuine, accurate
  • and reflect the true nature of the service offered. Posting misleading details may result in the removal of the profile from the website, at the sole discretion of the Company.

  • Verification of Posted Information and Assistance in Case of a Misleading Profile
  •  
  • 10. The Hosting Families / Flat Owners are fully responsible for the reliability of the details and information posted within the profile.
  • The Company will invest reasonable efforts in verifying the details posted by the Hosting Families / Flat Owners, HOWEVER, IT IS THE OBLIGATION OF THE TRAVELERS AND THEIR FAMILIES TO VERFY THE DETAILS AND INFORMATION POSTED, AND THE COMPANY CANNOT AND WILL NOT BE HELD LIABLE FOR ANY MISLEADING PUBLICATION POSTED THROUGH THE WEBSITE, INCLUDING (BUT NOT LIMITED TO) MISREPRESENTATION REGARDING ISSUES WHICH MAY BE CONDISERED ISSUES OF FUNDEMENTAL IMPORTANCE (SUCH AS SLEEPING ARRANGEMENTS, THE EXISTENCE OF A KOSHER KITCHEN / CONSUMPTION OF KOSHER FOOD, ETC.).

  • 11. Notwithstanding article 10 above, the Company will do its best to assist Travelers in locating alternative accommodation (at the Traveler’s expense), in any of the following cases:
  •  a. There is a fundamental discrepancy between the sleeping arrangements and / or the area of the Hosting Family’s residence and the description posted by the Hosting Family;
     b. Inadequate sanitary conditions;
     c. Special amenities and/or features represented in the listing are not provided or do not function.
  •  
  • Travelers who encounter such misrepresentations are requested to contact the Company, no later than 48 hours after check-in, through the contact section of
  • this website or by using the following email address: Isradreams@Israelexperience.org.
  • In cases where no alternative accommodation is available, the Company will refund the accommodation fees paid by the Traveler in advance (excluding the Company’s fees, air fare or sums paid for services already rendered).

  • 12. Without derogating from the above – THE COMPANY EMPHASIZES THAT ITS UNDERTAKINGS UNDER ARTICLE 11 ABOVE SHOULD NOT DEROGATE FROM THE OBLIGATION OF THE TRAVELER AND THE TRAVELER’S FAMILY TO CONTACT THE HOSTING FAMILY OR FLAT OWNER, PRIOR TO THE ARRIVAL OF THE TRAVELER TO ISRAEL, AND ENSURE THAT ALL DETAILS POSTED IN THE HOSTING FAMILY’S OR FLAT OWNER’S PROFILE ARE ACCURATE AND ACCEPTALE TO THE TRAVELER AND THE TRAVELER’S FAMILY, AND THAT THE ACOMMODATION OFFERED IS COMPATIBLE WITH THE TRAVELER’S EXPECTATIONS. IT IS HIGHLY RECOMMENDED THAT THE TRAVELER AND THE TRAVLER’S FAMILY HOLD AT LEAST ONE VIDEO CONFERENCE WITH THE MEMBERS OF THE HOSTING FAMIY AND GET A FIRST HAND IMPRESSION.

  • Pricing, Payments and Cancellation Policies
  •  
  • 13. SERVICE RATES ARE SET AT THE SOLE DISCRETION OF THE HOSTING FAMILY / FLAT OWNER. THE COMPANY WILL PROVIDE A CLEARING SERVICE ALLOWING THE EFFECTIVE TRANSFER OF PAYMENT VIA CREDIT CARDS, HOWEVER, THE COMPANY WILL NOT BE OBLIGATED TO EXAMINE THE PRICING POLICIES OF THE HOSTING FAMILIES / FLAT OWNERS OR DEAL WITH COMPLAINTS RERGADING UNREASONABLE OR INCOMPATIBLE RATES.

  • 14. Payments cleared through the website will be charged to the Traveler’s account as follows:
  •  a. Payments for Hosting Services:
  •  i. 30 (Thirty) days prior to the scheduled check-in date or;
  •  ii. On the actual check-in date, if the reservation was made within 30 days if the scheduled check-in.
  •  b. Payments for attractions: On the reservation’s confirmation date by the vendor.
  •  
  • 15. By posting their profiles on the website, all Users agree to observe the following cancellation policy:
  •  a. Cancellation by Travelers
  •  i. Hosting Services:
  • Flat owners are requested to indicate which of the following cancellation policies they decide to choose:
  •  a) Flexible Cancellation Policy: Travelers may cancel their stay until seven days prior to the scheduled arrival date, with no cancellation fee. In case a cancellation notice is delivered within a period of less than seven days prior to the scheduled arrival date, a cancellation fee equal to the price for one night will be charged. In case of cancellation after the arrival date, travelers will be eligible for a refund in the amount paid for the remaining nights save a cancellation fee in the amount paid for one night.
  •  b) Standard Cancellation Policy: Travelers may cancel their stay and receive a full refund if they deliver their cancellation notice at least fourteen days prior to the scheduled arrival date. In case a cancellation notice is delivered within a period of less than fourteen days prior to the scheduled arrival date, a cancellation fee equal to 50 percent of the amount paid for the entire stay will be charged. In case of cancellation after the arrival date, travelers will be eligible for a refund of fifty percent of the amount paid for the remaining nights beginning on the night following the delivery date of the cancellation notice.
  •  c) Strict Cancellation Policy: Travelers may cancel their stay and receive a full refund if they deliver their cancellation notice at least twenty one prior to the scheduled arrival date. In case of cancellation within a period of less than twenty one days prior to the scheduled arrival date, travelers will be eligible for a refund of fifty percent of the amount paid for the remaining nights. In case of cancellation after the arrival date, the cancellation fee will be equal to the total amount paid for the entire reservation.
  •  d) The Company’s commission will be added to all cancellation charges.
  •  
  •  ii. Vacant Flat Rentals:
  •  a) Flexible Cancellation Policy: Travelers may cancel their stay until forty eight hours prior to the scheduled arrival date, for no cancellation fee. In case a cancellation notice is delivered within a period of less than forty eight hours prior to the scheduled arrival date, a cancellation fee equal to the price for one night will be charged. In case of cancellation after the arrival date, travelers will be eligible for a refund in the amount paid for the remaining nights save a cancellation fee in the amount paid for one night.
  •  b) Standard Cancellation Policy: Travelers may cancel their stay and receive a full refund if they deliver their cancellation notice at least five days prior to the scheduled arrival date. In case a cancellation notice is delivered within a period of less than five days prior to the scheduled arrival date, a cancellation fee equal to 50 percent of the amount paid for the entire stay will be charged. In case of cancellation after the arrival date, travelers will be eligible for a refund of fifty percent of the amount paid for the remaining nights beginning on the night following the delivery date of the cancellation notice.
  •  c) Strict Cancellation Policy: Travelers may cancel their stay and receive a full refund if they deliver their cancellation notice at least fourteen days prior to the scheduled arrival date. In case of cancellation within a period of lets than fourteen days prior to the scheduled arrival date, travelers will be eligible for a refund of fifty percent of the amount paid for the remaining nights. In case of cancellation after the arrival date, a cancellation fee in the entire amount paid for the entire stay will be charged.
  •  d) The Company’s commission will be added to all cancellation charges.
  •  b. Cancellation by Flat Owners / Hosting Families
  •  
  •  i. Flat Owners / Hosting Families will be charged with a penalty fee of 50 U.S.D for any cancellation until seven days prior to the scheduled arrival date. In case of a cancellation within a period of seven days prior to the scheduled arrival date, Flat Owners / Hosting Families will be charged with a penalty fee of 100 U.S.D. The penalty fees will be subtracted from any payments due for future services.
  •  ii. Any cancellation by a Flat Owner or a Hosting Family will result in the posting of an irremovable notification on their website profile.
  •  iii. No alternative reservation will be approved to replace a reservation cancelled by a Flat Owner / Hosting Family.
  •  iv. Flat Owners / Hosting Families may cancel a reservation and not be charged with penalty fees, if:
  •  a) The reservation is cancelled no later than twenty four hours after it was placed and;
  •  b) The Traveler received negative feedbacks posted on his / her profile or; the Traveler did not respond to questions / communication sent by the Flat Owner / Hosting Family with respect to the reservation; or the communication with the Traveler indicates that he / she does not intend to observe the house rules set by the Flat Owner / Hosting Family (i.e. a non-smoking rule; no pets allowed etc.).

  • Damage Reimbursement
  •  
  • 16. The Hosting Family / Flat Owner will reimburse the Company for any damage incurred by the Company in connection with the situations described in articles 9 and 10 above.
  •  
  • Travel and Health Insurance
  •  
  • 17. Travelers should purchase health and travel insurance policies covering the entire scope of their planned activities in Israel, including extreme sports, if relevant. The policies should be purchased from recognized and reputable insurance companies, and should be valid for the entire duration of the insured Traveler’s visit. The services offered by the Company DO NOT include insurance coverage.

  • Minor Participants
  •  
  • 18. Travelers under the age of 18 may not register for the service unless they obtain the consent of their legal guardians. In the case of a minor Traveler, the legal guardians must sign all forms and undertake, on behalf of the Traveler, all obligations as required under these terms of service. Travelers are required to state their age as a part of the registration process.
  •  
  • 19. BY OFFERING ACCOMMODATION TO A MINOR TRAVELER, HOSTING FAMILIES UNDERAKE TO BE RESPONSIBLE FOR THE TRAVELER’S WELL-BEING WHILE IN ISRAEL, AND PROVIDE THE TRAVELER WITH ANY POSSIBLE ASSISTANCE IN CASE OF ILLNESS OR MEDICAL EMERGENCY, INCLUDING: ASSISTING THE TRAVELER IN MAKING AN APPOINTMENT WITH A SPECIALIZED PHYSICIAN AND ACCOMPANYING THE TRAVELER TO A MEDICAL FACILITY, ASSISTING THE TRAVELER IN CONTACTING THEIR INSURANCE COMPANY, ACTING AS CONTACT PERSONS ON BEHALF OF THE TRAVELER, INFORMING THE TRAVELER’S FAMILY OF THE SITUATION AND ACTING AS A LINK BETWEEN MEDICAL AUTHORITIES / INSTITUTIONS AND THE TRAVELER’S FAMILY ABROAD, AND ASSISTING THE TRAVELER IN THE ORGANIZATION OF ALL NECESSARY PAPERWORK.

  • Medical Conditions
  •  
  • 20. By signing up on the website, the Traveler and his / her guardians declare that the Traveler is fit in all ways, including medically and physically, to travel to Israel and participate in the hosting program. Travelers who suffer from chronic medical conditions which require constant attention and care must inform the Hosting Family of said situation prior to the Traveler’s arrival.

  • Safety and Security Recommendations

  • 21. We strongly advise that Travelers take note of the detailed safety and security advice, which can be found on our website.
  •  
  • Content Restrictions and Intellectual Property

  • 22. Hosting families and / or Flat owners and / or Travelers and / or Traveler families are not allowed to use this internet platform to post offensive language including any kind of derogatory remarks regarding a person’s origin and / or ethnicity and / or sex and / or sexual orientation. In addition, Users are not allowed to upload any explicit material, including nudity, offensive or abusive videos, slogans soliciting violence of any kind, or any commercial material.
  •  
  • 23. It is important to emphasize that the purpose of this internet platform is by no means to assist Users in finding dates or sexual partners but rather to offer a platform for strengthening the connection between the State of Israel and world Jewry. Users of this website must refrain from using this website for any kind of sexual or matchmaking purposes.
  •  
  • 24. No aggressive, harassing, intimidating or inflammatory behavior is allowed on the website.
  •  
  • 25. Any content subject to intellectual property should not be uploaded to the website without the prior written consent of the proprietor, a copy of which must be delivered to the Company.
  •  
  • 26. By posting information on the website, the User grants to the Company an unlimited, worldwide, royalty-free right to store, distribute, publish, edit, transfer (in whole or in part) and otherwise use said information, in any way, media and platform the Company may see fit, as long as said use is within the purposes specified in these terms of service and specifically in the Privacy Policy section.

  • 27. Any use of the website contents or platform for purposes other than those specifically mentioned in this document is strictly prohibited. Users may not copy, distribute, publish, transfer or make derivative works of the website contents without the prior written approval of the Company.

  • Damage to Flats
  •  
  • 28. Travelers undertake to treat all property with care and respect, and vacate the flats (and any property contained inside them) in the same condition they were in upon arrival.
  •  
  • 29. The Traveler will be fully responsible for reimbursing the Flat Owner for any damage or loss which may have been caused by the Traveler and / or his / her guests.
  •  
  • 30. The Company does not offer claim settlement services with respect to property damages, and Users cannot hold it liable for any claim regarding any such damage and / or loss.
  •  
  • 31. The Company strongly recommends that Hosting Families and Flat Owners purchase adequate insurance policies which also cover any hosting activities.
  •  
  • Sanctions
  •  
  • 32. The Company, at its sole discretion, may delete any information which was posted on the website and cancel the profile of any user, in any of the following cases:
  •  a. The information posted does not comply with the rules set herein and general law.
  •  b. The User has breached his / her obligations under these terms and / or violated any applicable laws and / or regulations and /or third party rights.
  •  
  • 33. Cancellation under said circumstances will not result in any compensation payment to the breaching user, as well as other parties transacting with said User through the website.
  •  
  • Restrictions on Data Use and Privacy Policy

  • 34. The Company takes privacy issues relating to information posted on-line very seriously and applies reasonable and acceptable technological means to ensure that information posted onto this internet platform is properly secure against hacking and inappropriate use by unauthorized entities. However, users should take into account that no protection is completely fail-safe, and therefore be aware that information posted on to the site may be exposed.

  • 35. IE will use the posted information only for the following purposes:
  •  a. Sharing relevant information with vendors and partners (such as hotels, guest houses, travel companies etc.), for operational purposes only;
  •  b. Connecting between travelers and hosting families / flat owners offering services in accordance with the terms of this document;
  •  c. Subject to the User’s consent:
  •  i. sending invitations to Alumni events and other relevant events such as events for Jewish communities in Israel and the Diaspora;
  •  ii. Sending announcements and other material regarding educational programs organized by IE (such as: “Birthright” and “Massa” programs, internship and long term programs in Israel etc.).
  •  iii. Sending invitations to participate in surveys.
  •  
  • 36. Users should therefore indicate, as an integral part of the registration process to the website, if they agree to:
  •  a. Allow the use of their personal information for marketing purposes via social media;
  •  b. Allow IE to use their personal information for the purpose of conveying information regarding events and / or programs via email / text messages;
  •  c. Allow IE to use their personal information for the purpose of sending invitations to participate in online surveys.
  •  
  • 37. Travelers, Hosting Families or Flat Owners who wish to be erased from the database may forward a written request to the following email address: Isradreams@israelexperience.org.
  •  
  • 38. IE will use the contact details uploaded by Travelers, Hosting Families or Flat Owners for the purposes mentioned above.
  •  
  • 39. IE does not use this website for information mining of any kind (except for information directly uploaded by the users). However, IE may use, from time to time, statistical tools provided by third parties (such as “Facebook Pixels” or “Google Analytics”) in order to better understand the online behavior of surfers visiting any of IE’s websites. This statistical information may be used to help promote campaigns launched by IE. However – the data does not include, under any circumstances, any information which may lead, directly or indirectly, to the identification of a specific person.

  • 40. Users are responsible for maintaining the confidentiality of their profile / account credentials and must inform the Company immediately in case they have reason to suspect that their account has been hacked or their credentials have been leaked or used inappropriately.

  • Taxation Issues

  • 41. Hosting Families / Flats Owners should be aware that tax charges may apply, and make the necessary inquires prior to posing their profile onto the website. The Company will not be held liable for any applicable tax payments due in connection with the services offered through the website.
  •  
  • 42. In accordance with Israeli Law, VAT will not apply to tourists (foreign nationals who are not permanent residents of the State of Israel). Travelers who fill in foreign passport information will not be charged with VAT. The Company will bear no responsibility in case of fraudulent use of the website or misuse of foreign passport information by individuals who are not eligible for VAT exemption under law.

  • Experiences
  •  
  • 43. The Company offers various suppliers the opportunity to use the website as a platform for advertising experiences and activities throughout Israel and as a clearing service for payments and bookings. The description of any such activities is based solely on information provided by the service provider. The Company is under no obligation to check and / or validate any such information provided by third parties and will not be liable in case any such information turns out to be misleading and / or false. Travelers should carefully consider the risks any extreme and / or sporting activities may entail before booking.

  • 44. It should be noted that the Company is not the organizer of these experiences, and the full responsibility for providing the offered services, as well as for compliance with any legal aspect and obligation they may entail, lies solely with the service provider.

  • Applicable Law and Jurisdiction
  •  
  • 45. The engagement under this document is subject to the laws of the State of Israel and all disputes in connection with the Hosting Services or arising out of this document shall be submitted to the exclusive jurisdiction of the civil courts of the Jerusalem District in Israel.
